TERMS OF SERVICE: AI RETROFIT

  1. NO FINAL QUOTES: The AI is strictly forbidden from giving fixed prices. You must confirm the final price.

  2. NO CONFIRMED JOBS: The AI books "Site Inspections" or "Call Backs" only.

  3. OUTAGE PLAN: If the system goes down, we will SMS you a code (e.g., ##61#). It is your responsibility to dial this code to restore normal phone function.

  4. IT IS A ROBOT: While smart, the AI is not human. You agree to verify all booking details sent to you.

 

1. ACCEPTANCE OF TERMS By engaging The Ideas Bunker, you agree to be bound by these Terms.

 

2. NATURE OF THE SERVICE (AI DISCLAIMER) 

2.1 Not a Human: The Service utilizes Artificial Intelligence. Responses are generated by a Large Language Model (LLM). 

2.2 Accuracy: We do not guarantee 100% accuracy. You (The Client) agree to verify all booking details (Time, Address, Name) sent to you by the AI before attending a job. 

2.3 Agency: The AI acts as your agent. Any statement made by the AI is deemed to be made by you.

 

3. SCOPE OF AUTHORITY 

3.1 No Final Quotes: The AI is strictly prohibited from providing binding fixed-price quotes. It may only quote your standard "Call-Out Fee." 

3.2 No Job Contracts: The AI books "Site Inspections" or "Assessments" only. It does not create binding construction contracts.

 

4. FEES & CANCELLATIONS 

4.1 Setup Fees: The Setup Fee ($900 + GST / $1,500 + GST) covers the configuration and programming labour. It is non-refundable once work commences. 

4.2 Cancellation: You may cancel the monthly service with 7 days' written notice. 

4.3 Fair Use: Unlimited plans are capped at 1,000 minutes per month to prevent commercial abuse (e.g., call centers).

 

5. LIMITATION OF LIABILITY To the extent permitted by law, The Ideas Bunker's total liability is limited to the total amount paid by you in the 3 months preceding the claim. We are explicitly not liable for indirect losses, including lost profits, missed bookings, or technical outages.

 

6. REVIEW BOOSTER & SPAM ACT COMPLIANCE 

6.1 Your Responsibility: You authorize us to send SMS messages to your customers requesting Google Reviews. 

6.2 Consent: You warrant that you have obtained the necessary consent from your customers to receive these marketing messages. 

6.3 Indemnity: You agree to indemnify The Ideas Bunker against any claims, fines, or penalties arising under the Spam Act 2003 (Cth) resulting from messages sent on your behalf.

 

7. THIRD-PARTY PLATFORMS (THE DIGITAL OFFICE)

7.1 Pumble & Twilio: We configure accounts for you on third-party platforms (e.g., Pumble, Twilio). 

7.2 Service Availability: We are not responsible for outages, data loss, or service changes caused by these third-party providers. 

7.3 Data Storage: While we prioritize Australian data security, you acknowledge that some third-party processors (e.g., OpenAI, Vapi) may process data in overseas jurisdictions (USA).
